Cambria: Lynch's treatment not "special"

(WGR 550) -- As Marshawn Lynch hasn't spoken to police on the advice of his lawyer regarding the alleged hit and run Saturday morning on Chippewa Street in downtown Buffalo, WGR sought out one of the nation's best defense lawyers for his perspective.

Paul Cambria, the Buffalo native who's defended Larry Flynt, DMX and Marilyn Manson amongst others, joined Jeremy White and Dennis Williams on The Howard Simon Show.

Cambria said was asked whether Lynch has been getting special treatment from the police.

"Not that I can see," Cambria said. "They've obviously impounded his car and gone public with a press conference, so that doesn't seem to me like he's getting any special treatment, except to say that he's being singled out. If this happened to an ordinary individual... this wouldn't be happening."

Cambria agreed with Williams that it could be considered "negative special treatment."

"If they don't have a basis to go forward on an individual, they can't impound the car, and he has a right not to speak with them like any other citizen, and it should be respected for whatever reason."

The lawyer told White and Williams that Lynch doesn't have to say anything.

"The burden's on the prosecution. I heard another statement yesterday about (Lynch's actions being an) obstruction of justice. If you don't speak to the police, that's your right. For someone to say that, that's pretty irresponsible."

"The assumption is that he's the driver, and I don't think anyone has confirmed that. If so, I would handle that in a particular way. Does he know who the driver is? I would handle that perhaps in a different way."

Cambria detailed why a lawyer may wait to address a case for several days, as Lynch's representation has done.

"If I didn't think the prosecution could prove their case, I wouldn't supply the proof. I've had plenty of cases over the years where the prosecution was totally convinced that the person I represented had something to do but they couldn't put it together. No citizen has the obligation to incriminate themselves. In fact, they have the right not to."

What would Cambria ask Lynch if he were the back's attorney?

"If he were the driver, I'd be interested in the facts," Cambria said. "Is it someone you can see, who should've been seen? Is it someone who darted out (into traffic)? Was there great impact? Was the radio playing? If you just graze someone, you might not even know it, especially if they had dark clothing on late at night. All those things would be important to know."
